Question

Is it possible to sue the state of VA for a guardian ad litem whose bias made him incapable of being fair? I was given custody of my son in the pende lite hearing so I agreed to share custody with my husband. Big mistake. The GAL is going through his own personal divorce and used a bias in the final hearing in granting my idiot disbarred lawyer husband residence (but joint custody) of my son. The extorted agreement was that I would give up my house in order to continue having residence with my son. He's 14 and shouldn't have a gAL to begin with but coincidentally this GAL just happened to be in court at the fist hearing and he was nominated to be on the case cause he was there. He didn't have a reason to be there to begin with. Please tell me I have rights to do something about this. If I didn't agree to the divorce agreement I would have had to pay child support because I earn 80K a year and my disbarred lawyer husband earns 35K. He's a loser who doesn't even try to earn a living.

Make an application to void the appointment and acts of the GAL due to the facts you present here. Submit documentary evidence if any and statements of any witnesses to the events. You can't predict the outcome, but under the circumstances, I would not let the situation stand without a fight.
