Question

I currently have a employment discrimination case based on race, age etc in Federal Court. My attorney withdrew at a crucial phase and I have been searching for another lawyer to represent me but have been unsuccessful. I have continued pro se and have asked the judge to grant me time to find counsel. I have filed a motion asking the judge for time to find counsel until the end of the month. My employer has recently had a realignment in my department and consequently offered two options. One would be a demotion resulting in a approximately a 40 % loss in wages whilst promoting other younger, less experienced and less qualified employees than me. Second option offered was to keep my current zone but relocate to another far more costly area in the country whilst my current peers (in terms of qualifications) offered promotions and consequently far more money. I believe I have been retaliated against. I have been told I need to file with EEOC. How do I protect my case in Federal Court?

Answer

Your case in federal court is protected once it was filed. This retaliation claim is an entirely new claim and you need to just file the complaint with the EEOC and they will investigate. To find a new attorney, the best way is to go to http://www.martindale.com, which is the same site attorneys use when they need to find other attorneys. Try to find one of the big employment firms in ATL like Jackson Lewis or Littler Mendelson, these firms handle nothing but employment cases and could be a big help to you.
