I haven't worked since Apr of this year. I've received unemployment benefits for this time and have been granted an extension. My question: Can my boyfriend(domestic partner of 5 years) claim me and my 13 yr old this year? We live in WA state.

Just looking ahead. He is single with no right-offs(house,kids...) I think we have to be married, he doesn't think so.

Hello there,

 

Your boyfriend can only claim you if you meet the definition of "qualifying relative". This would include making less than the exemption amount $3500 in 2008 and living with him all year.

 

Also, he cannot claim your daughter because she is a qualified child of yours, even if you do not claim her---unless you are not required to file a tax return---which I doubt is the case if you have been receiving unemployment benefits for most of the year.

 

If you are required to file a return and are not a dependent for your boyfriend, then you should file a return and claim your daughter. Since you have earned income (worked until April) you most likely will receive a refund of taxes withheld and be eligible for the earned income credit.

Thank you for your quick response. Can I ask what the difference would be if we married before the end of the year, would he be able to claim us then? or would filing jointly more advantagous?
