Hello, this is an extraordinary question, but I need some assistance here. Friday, October 10th, my fiance's cat of 19 years passed away. He decided to have him cremated on October 13th. We were present for the procedure so we could be sure that the remains were that of "Woody" It turns out that the worker neglected to empty the remains of the DOG that was cremated before Woody. Imagine our dismay (especially my fiance's) when we realized what had been done. Certainly the worker said he was sorry and he even blamed it on us (that we were rushing him) We were treated horribly. The bottom line is: We have Woody's remains but we also have the remains of a Mastif MIXED UP WITH OUR CAT! The business didn't conduct themselves in the best manner at all. They even attempted to make us pay for the cremation! How can we get the word out about how this company operates without being sued for slander?! Also, do we have a case here? My fiance is literally sick over this episode!! HELP! Renee

If it were a person and not a cat - you would presumptively have a cause of action for punitive damages. However, recent case law (not in Pennsylvania) in California have awarded intentional infliction of emotional distress in these same instances - punitive damages have been awarded. There are no Pennsylvania cases on the subject.

 

You can't be sued for slander - file a complaint with the veterinarian association and the BBB.
