Question

I finished deffered ajudication probation for a felony of Indecency with a child. In reference to buying a fire arm what does the federal law say about deffered ajudication. Is it a conviction or not??? I thought it was not. In other words can I buy or possess a weapon.

Bought a 45 pistol 6 months ago no problem. Went to buy another a couple of weeks ago(a 12 gauge shotgun for hunting) and was denied. Currently trying to appeal but not sure what my rights are.

No, it is not a conviction. The agreement was that if you successfully completed the requirements of your program, the prosecutor would not prosecute. Without prosecution, you can't be found guilty, i.e., convicted. That is what is meant by deferred adjudication -- they deferred the resolution of the case pending your completing the requirements of your program.

So, you can truthfully say you have not been convicted of this offense.
