Optional Information

Mesa, Arizona

This is new to all of us and there are issues that her husband needs to take care of (she was the main bread winner and took care of the bills and money). Not that I don't trust him but the reason she did this was his ability to make good decisions and prioritize things were a bit inmature.

It is my understanding that he just needs it to take care of the house, 2 car payments and her cell phone. One of the cars is in her name only and the loan is in her name only with a credit life rider on the loan. I am sure I can get her cell off my self and I have told her husband that.

He does not have one. He is trying to get one and his parents are going to hire an attorney to help him. Is there another way he can do what he needs to do without getting a power of attorney

Accepted Answer

He can be appointed her guradian/conservator. The spouse has the sole and exclusive right to petition the court for same. Parents in such a case cannot do anything unless you can explain to the court that he is unfit in some way. I am sorry I don't have better news.
