Question
I have a concern. With Employment Law. I have been suspended with out pay over the phone aprox 730pm one friday night. On this suspencion there was no paper work to indicate what grounds for this. And there is none to date and has now been three weeks The DON of the facility said until we meet to resolve this matter you will be suspended. I went in on a monday aprox 300pm for a meeting and to pick up pay roll I informed the DON that I needed to go after waiting 30 min and asked to call her for another meeting...She said okay sorry thae day has been hectic and sorry she couldnt meet I called to meet her set up appointment. I went in the following thursday I presented her with a statement I typed up of events in question with all addressed she stated she will call in a couple of days it is now the following week I called to make contact twice no success Left messages No contact. And still no explanition of suspencion. CO-Hand book states no suspencion with out pay unless found fau

To facilitate a thorough investigation prior to disciplining an employee, maniagement may place an employee on an unpaid suspension. Normally, such suspensions will not exceed three days, but may be extended in unusual circumstances. If the results of the investigation indicate that neither discharge nor any other disciplinary action is warranted, the employee will be returned to active duty and will be paid for scheduled workdays during the suspension period. If the results of the investigations indicate that diciplinary action less severe than discharge is warranted, the employee will be returned to active duty, but will not be paid for the suspension peiod.
today 10/13/08 at 200pm I attended a nurses meeting after the meeting several fellow employees informed me that I no longer worked there and they hired someone else in your place through what the schedule showes. 10/10/08 I called the DON of nursing left a message stateing I had not heard from her and wanted to make a followup meeting. I called twice the second later in the day. No reply. Later that night I went to the facility to pick up a employee hand book. The DON came in and told the on staff that they are going to cut staff 3 on the 1st shift 2 on the second shift and 2 on the 3rd shift and also reminded the staff of the meeting. I didnt know of the meeting that was manditory until that night. The DON stated I havent took care of the situation with you yet Ill get back to you in a couple of days.
10/02/08 This is the day for the second scheduled meeting at 300pm I arrived at 250pm I in advance typed up supplemental nurses notes and handed to the Director of Nursing of the issues that needed to be clairified. She said can you tell me what happened that night with the resident. I gave her the paper. She stated you deny telling the male resident that he couldnt use the phone. I told her I did not tell him he couldnt use the phone. She also said how long was the time that passed when the call light was answered. I told her that from the first the CNA answered then the second CMT answered light was about 10 min it was about 9 from the computer log. Then the third was the pull light in the room when the CNA returned. The first light was never reset untill 30 min had gone by the call lights in question were in one room. The DON stated that the residents do not want me in there room.
09/29/08 I arrived at the facility at 250 pm notified the DON I was there for our scheduled meeting at 300pm she stated could you go up front and wait until I come up there. I waited until 330pm and went to tell her that I had to go for I had class at 400pm she told me sure no problem Its been a little hectic here today. I asked if I could call her she said yes. I called to make a scheduled meeting for thursday. In the mean tome I went up to the residents room the residents reaction of me in there room was good and there was no indication there was any problems with me infact they thanked me for comming by and checking on them.
09/26/08 I was called at aprox at 730pm by the DON notifing me of suspension with out pay until a meeting has been held. She said the time of the calls lights are in question and the daughter states that her father stated that CMT told him he couldnt call on the phone. I then called my superviser which is no longer working at the facility now her last day was sometime in october. I informed her of the situation her statement was thats wrong they cant do that the hand book says differantly.

The parent company is based in Texas and I work in MO in a new facility. I started working there in Dec 24 07 before they were state approved.

If an employer is not following the employee manual concerning suspension and termination, you can seek to file a wrongful termination claim. You are best doing so through local employment counsel.
