Question

My husband received a 20 year sentance for delivery of 1lb of pot in 1996 first offence. He served 5 yrs in prison and 7 on parole. He has received 2 DWI's in the past 2 yrs and got probation for both.. The parole board revoked his parole and took back his good time. He is now on a year set off. Okay, in saying all of this we are trying to see about getting a motion to reduce the origanal sentance. Or try to get his good time back. He has kept employment and other than the DWI's has not been in any other trouble. The Sheriff in out county (Jim Wells) is keeping him here in the county jail due to him knowing my husband is a good man. Please if you can steer me in the right direction it would be welcomed with open arms. Oops.. We are in Texas....Thanks

Answer

You can file a motion to reduce the sentence, but it is going to be difficult. Your husband violated his parole twice. Normally sentence reductions or reduction in charges are done for people who do not violate the law again. Your husband did it not just once, but twice. Your best bet is to have him serve a year or two and show good behavior. Then obtain letters from people in the community about your husband's character and submit those with a motion, but understand the chances of it being granted are very slim.
