You may have your attorney file a petition for contempt. The willful failure to abide by a court order is punishable in a contempt petition. Your attorney will be able to request the judge incarcerate your ex for his willful failure to meet his court ordered obligations.

In that case you would simply have to sue him for breaching the contract. If the agreement was incorporated into the divorce decree then it would still be a contempt issue, but if it exists outside the divorce you may only be able to sue him for breaching the contract. You should really discuss that with the attorney who drafted the documentation as it would be unusual to have an alimony agreement that was not part of the final decree of divorce.
