Hello, my son is 20 yrs old and got a DUI. the officer wrote him up with 3 different types of DUIs. My son is trying to join the army and is not able to with this charge and the recruiter talk to the officer and was told nothing he can do it is up to the district justice. So the recruiter talk to the District Justice and was told talk to the officer and I will go along with whatever he wants. Who is the one that can make the change

The prosecutor / prosecutors office on the case is the only one who can amend or drop the charge, to something that will not interfere with your son joining the Army. The best approach is to hire an attorney to speak with the prosecutor, on your behalf. Obtain a letter from the Army, saying that they want to except your son but the DUI charge is preventing them. The attorney can try and speak with the prosecutor, explain the situation and see if some type of plea agreement can be worked out, where your son joins the Army, in exchange for a lesser charge, which would not disqualify him from admission. The prosecutor, if they are comfortable with this, will speak with the Officer and see if they have any objection to it.
