Question

I am a union employee and have filed 2 grievances with my company 1st for Policy they implemented May 2007 regarding Family Medical Leave Act ( discriminates against the Clerical employees having the same rights as T&E employess and provided proof to show this has been done and allowed from May 2007 until June 2008), have also contacted the US Department of Labor regarding this also. 2nd I filed a grievance of Slander Defamation of Cariter and Sex Discrimation when applied for Engineer Training Program and was not given a interview for it after a Official Slandered me infront of 7 other employees Want to know if should sue because of this I know have no chance for making 80,000.00 or more a year and currently only make about 40,000.00. They are trying to see if I will except a small settlement and I do not feel it is a Fare amount. What should I now Do.

I have brought the grievance numerous times to my union griever and he always says he will handle it I brought it to the Internation Union and nothing was changed,corrected,or modified only was intemidated, harassed and nothing was done fregarding the FMLA So I filed paper work with PROOF to the US Department of LAbor and waiting for them to investagate the Policy that discriminated being unfair to all employees and have proof. Regarding the Harassment, Slander, Defamation of Carieter I filed with the EEOC against the Union and the Company and am waiting for something to be done also have proof of the harassment, Slander ( 2 people came forward and 1 of them signed a statement showing this was done.) also Sex discrimination grievance filed ( Sex ) was not given a interview for the Engineer Training Program offered thru work and was the only female who put in for it. Again the company is trying to offer a small amount to drop and I feel that they have denied me from making double my income and chance for advancement and also slandered me infront of other employees. What price can you put on all of that not to mention they harassed me intimated me and restricted me under the FMLA Policy the company invoked May 2007 until present not treating all employees fairly under this policy and have submited proof regarding this as well with the US Department of Labor. My question is what do I do I do not feel this offer is Fair at all and I do not have 10,000.00 dollars for a Federal Attorney?

Answer

As far as the FMLA violation, the EEOC would have been the proper agency to file that complaint with as well as the discrimination complaint. You can sue on the harassment and FMLA violation only when the EEOC gives you a right to sue letter. You should stay in contact with the EEOC and ask about when they will provide you your right to sue letter.

AS far as your union, if they are not representing you in a fair and equal manner, a union can also be sued for discrimination and unequal representation. They have a duty to bring forth grievances from the members and if they are not doing so, you would have to sue them for breach of contract, breach of duty and possibly unequal representation and discrimination.

You would need to hire an employment law attorney for this and you will have to search for one who will take this on a contingency basis and there are many out there who will do so. My question is should I take the small proposed amount that the company is offering knowing it is not a fair amount, because they did not give me the opportunity to get into the Engineer Training Program thus would make 80,000.00 yearly or MORE and could of also gave me more advancement later currently I only make about 40,000.00 or should I continue forward possible law suit?

You should not settle for the first offer they are making. You need to do the math on this one and figure how much you would have made over and above what you make now and how long you would have likely remained at that job to determine how much this case is valued at. Of course, in suing you always run the risk of not winning, but I certainly would never recommend taking a low offer and if they refuse to come up to something you think is fair, then you should indeed sue.
