Question

Recently, a Guardian Ad Litem was assigned to my daughter(after her father molested her), whom slandered me in a court of law last year during another case. I was slandered because of his experience with a sister of mine, which again had no bearing on the case last year. I find that he is biased and don't feel that I can anyway meet his approval. Is there a way to get a new GAL assigned?

Since it was DSS that started the investigation and brought in the local police,after I reported what my daughter said, I asked them if they could get a re-assignment of another GAL.

Hi and thanks for your question.

 

Typically it is very difficult to remove a guardian ad litem from your case; however, in your situation where there is a history of the gal involvement with your sister, you may have a strong argument for her removal.

Hi again.

 

I believe that you have a strong argument for your position to remove the GAL in light of the case law in Virginia - Virginia case law supports that if the person's interest requires the removal of the GAL, the court should remove the GAL and appoint another. You will want to file a motion to remove the GAL here and appoint another and include in your argument that your child's best interest is not being served due to the GAL's biases against you as a result of the GAL's previous history with your family member.
