Question

I have rented a room in my home to someone for the last 5 years. On September 10 I told him I was raising his rent from $700 to $850 on November 1st (I'm doing expensive improvements to the room). I wrote a new lease dated Nov 1, 2008 to Nov 1 2009 and asked him if he wanted to stay. He said no. I've given him notice to leave by Oct 31. He seems reluctant and says that I will have trouble evicting him. What should I do? Do I need restraining order?

Answer

After you serve the notice, you will need to go to housing court for an eviction order. You should not use self help or changing the locks, follow the directions of the housing court and you will have your eviction.
