Question

I have Been married since July 19, 2008. My 'husBand' has two children who were my godsons, ages 11 and 15. He has decided this is 'not working' and wants to return to the UK. We have just received confirmation of filing of their permanent status from immigration. Can I file for annulment? What can I do?

Thanks for your question. Georgia has limited rights to annulment. Unless you can prove some type of fraud then you would have to file for a regular divorce here. You would need to file your petition for divorce. You should do this before he leaves if possible here and have him served. you have my sympathy in this matter.

The only grounds for annulment here besides fraud are inapplicable in your situation. I think that you will end up filing a regular divorce here. The court or the parties will divide up any property and debts accumulated during this brief time. I am giving you legla reference to annulment grounds for your information here..

He has come to the US with no assets, only devt...how can I prevent him acquiring half of my assets?

He would only be entitled to an equitabele division of the few months or marriage. you could try for annulment and allege fraud. If they deny annulment then you can just amend for regular no fault divorce. You might very well want to give it a shot here because annulment would render this a moot question. A lawyer here would help protect you..
