Question

I recently worked two sixteen hour shifts without a break. I went into work yesterday and was told that my position as laundry-housekeeping supervisor had been eliminated along with the benefits that it offered. I was not fired but demoted. This is after my last last review which was exceptional. I've recently relocated my family to accomodate this job. Do I have a case? Were they in violation of labor laws by not allowing me a break?

This is the first step I have taken. I have built up quite a bit of pto time and would like to be compensated for it. I've been on the job since the building opened and have played an intrical part in it's success. I feel I have been treated poorly since they basically just dropped this on me and said "nothing personal". I basically just want my pto time so I can walk away. But employee handbook says I have to give 30 days notice to use it. I wasn't given any notice.

Answer

An employer can demote you as long as it is not discriminating on the basis of race/gender/age.

what state are you in and i will check on the breaks issue.
