I am a Foster parent that surpose to have Adopted. Decree of Adoption papers was filed. Surprising Nine months later, we find out that DSS had NOT done the TPR on the father. We have change name, had an Adoption party celebration w/ the agency, been the fouces spotlight in the company magazine,etc only to find out 09/17/08 that everything is beening amended. The chlid is notmine. What are my rights now? What can be done for such a problem cause by DSS.

Thanks for your question.They would have to complete the termination here before they can hear your adoption. I can understand and symapthize with you . This is outrageous that they have permitted this to happen.

I am assuming that they will proceed to complete the termination and then correct the adoption situation. At the least to me you are entitled to any legal or other fees or costs incurred by you as a result of their error. You may also have a claim against the agency for misrepresentation and negligence here.

You would need to obtain a lawyer if you want to pursue damages both real and for your mental anguish in the matter. You could certainly consider doing that here.Again I hope that this works out for you both in completing the adoption and if you desire to pursue the DSS here. I wish you good luck..
