Question

I was sentenced to 10 yrs probation for the sales of marijuana in 2002 in Billings, Mt. The actual sales were in 1997. I've been on probation for 6 yrs without any problems. What would the process be to try to get off probation at this point so I can move forward in my life? I live in Arizona, so one cannot obtain licensing for anything (real estate, massage, etc.) while still on probation.

Already Tried:
past probation officer in Az requested Mt to drop my probation because it is such a long time for 3 ounces of weed. I haven't been in any kind of trouble aside from this. It's been 6 yrs since my conviction. I don't owe any more fines or restitution. I'm on unsupervised probation now where I just write in once a yr to Montana. Mt declined this request 2 yrs ago. Where do I go from here? Can I write the judge directly and ask for him to drop the remaining time?

try for the abatement again - have your agent contact MT again and make the request; however, i would suggest that a copy also be submitted to the judge in the matter. the request package should include a letter from you and documentation of your family and community life with character references letters. ask your agent to present this package to MT and also send a copy of the request to the judge. if for some reason you agent is not inclined to copy the judge on the request, then you can send the judge the package and abatement request that was submitted this time to MT. i dont know if a judge will act unilaterally without the Petition coming from MT probation, but it wont hurt.

It was actually the probation officer in Montana that wanted me to do 3 yrs of actual time in a corrections facility. He has never been much help. I don't think going through the probation office is going to be a positive experience. Would you suggest just going straight to the judge, or the main probation office in Montana that is above my probation officer?
