Question

I just bought a used 328i convertable last week from a local used car dealer. It was running great when I bought it and 3 days later I had a cylinder misfire. I took it back to them and they checked the coil pack, spark plug, e.t.c. Then they were saying they would have to pull the head and check inside the motor. I told him I wanted my money back and I'll go find another car. He won't do that. Do I have any recourse, or am I screwed?

Tried changing plug, coil pack. They have said they would have to pull the head off. Then said it might be cheaper to change the motor. That is when I felt I was being taken for a ride. Do they have to give my money back? I only had the car for 3-4 days when it happened.

Absent a written guarantee, you do not have the right to return the car.


There is not a right of rescission on vehicles in Georgia. This applies even if you purchased an obvious lemon.


Generally speaking, there is a three day right of rescission on consumer transactions in the home. Perhaps that is what you were thinking about.


Your remedy would be to file suit against the dealer.
