Question

my roommate dissapeared about 2 weeks ago. she has not returned for any reason at all. I have tried contacting her and she will not answer me. all of her stuff is still in our apartment. my problem is she skipped out on the rent that was due on the 1st of the month. we got a letter from the apartments on the 4th that her 1/2 was past due (i had already paid my part). i told her and that was the last time i saw her. we were to get evicted if that money was not paid by the 9th of the month. i paid it so i would not get evicted. is there anything i can do to either make her pay me back or kick her out? she is also on the lease with me by the way.

Since she shares the lease with you, the landlord is the one who elects to evict her. What you can do is work out a new lease with the landlord in order to remove her from the present one. If the landlord does not agree to a new lease, then you can either elect to break the lease or continue to pay the lease as owed. For each and every time you pay her half, you have the right to sue her for breach of contract and recover what she owes you. Unfortunately this will require finding her and then suing her for the half she owes you.

As to her property, since her name is on the lease, the landlord nor you can treat her property as abandoned, it can only be disposed of if she gives consent to the disposal or you get a court order approving the disposal. To accomplish this you would first have to get her out of the lease agreement and then give her notice that if she does not pick up her property by a certain period of time that it will be considered abandoned.

If she no longer wants to be on the lease, then she, you and the landlord should work on creating a new lease, otherwise you are stuck with her on it unless you terminate the lease term.
