Question

I have been off work since January with a back injury. Two doctors have told me to try and change my position at work to allow for less physical labor in order to stay away from terribly causing more damage to my back. I applied for an inside position at work and did not receive it. When I questioned why, my response from work was because I didn't participate in a two month trial spot for this position. Before I was down with my back problems this two month trial was offer to all and I accepted. But due to my back issues I was unable to have the opportunity to prove myself in this two months. Because of this that is the only reason they stated I did not get this job. I guess my question would be is this legal for them not to give me this position because of my health issues keeping me from doing this two month trial. To me, that was disciminating against me. Please let me know what you think. Thank you.
