how do i check to see whether the ac is working on my 2008 528i

If you are talking about the sealed refrigerant system, the best way is to hook a set of gauges to it.
If you don't have the gauges.. you can feel the lines at the compressor. One will be hot, and the other will be cold. It is best to do it with the engine running (if it can be safely done, of course).

If there is no difference in temperature in the lines then look at the front of the compressor, when it is on.. the center part should be spinning.. That is the compressor clutch, which actually turns the compressor.

I forgot not to mention what kind of problem I ran into. This is a brand new car and I only had about 9500 miles on. The AC has been working great; in fact it gets to a point that it is so cold that my spouse had to turn the temperature setting up to 80 degree F. It has not had any problem until a copule days ago, all of sudden we didn't get much cold air like it has always been. What we had done wrong? Could setting temperature setting to a very high temperature cause this kind of problem?

I would get it back to the dealer, though.. Whatever is wrong with it should be covered under a warranty.

Without looking at the system, there is no way to tell you what's wrong.

Were the lines hotter and colder?

If you put it on a warmer temperature, then the AC will not come on... It might even blow the heat, of course.

But yes, there could even be a problem with the doors that control air, the motors that control them, or maybe even a clogged cabin air filter.... If the lines change temperature, when the AC is turned on.

The only thing that would not be covered under a warranty would be the cabin air filter. Here are the instructions for changing it. It only takes about 5 minutes.
