Question

i was recently fired from my job due to a sexual harassment claim brought by a coworker...she and i had a good relationship as friends (not sexual) wherein she and I had lunches together along with she allowing me to take her child for outings numerous times with my granddaughter...she wrote me emails and cards thanking me for gifts and for my friendship...i read that for harassment to occur actions must be unwelcome...i do not believe a reasonable person would conclude that a woman being harassed would allow her 8 year old daughter to spend day with said "harasser" nor write notes stating "thank you for your help and friendship..i will be in eternal debt to you..investigator of claim ignored these comments ..do i have i claim against the employer for wrongful termination

Optional Information

seaside, California

Already Tried:
spoke to state agencies who state they sympathize with
my plight as to be harassment must be unwelcome and fact
that she allowed me to take her child out for day 20 plus
times is certainly not something that a person being harassed would do, they do not have the ability to aid me

Hello, you bring up a good view, however it will depend when she identified when the behavior happen. Was it after the event with the daughter. You would need the total content of the investigation to determine if you have been wrongfully terminated.

You may want to consider retaining an attorney to help you with this situation.. An attorney may be able to gather more information to help determine if you have a case. But you bring up a valid question. You may also write an appeal letter to the top executive and give your side of the story and request to be reinstated. Discuss that this person allowed her daughter to be with you on a continous bases. I hope this has helped if so click accept.
