Question

I am an assistant manager with exempt status working for a company in Florida. Recently, I and my fellow assistant managers received a memorandum informing us that the minimum mandatory weekly hours we have to work each week was being raised from 46 hours to 56 hours. Is this legal? Is there any limit on the number of mandatory hours an exempt employee is required to work (Florida labor statutues or Federal statute)?

Answer

There are no laws governing the number of hours an exmpt employee can be made to work by the employer. Additionally, Florida law is the weakest labor law in the country and very slanted to the employer. The FLSA has no regulations governing exempt employee's hours either. Your status is subject to the agreement with your employer and absent a contract to the contrary with them, as an at will employee you must either work as directed or quit.
