Im in california and work as an independent technician installing Directv, about a year ago they asked us to start working on major holidays (new year, july 4th, labor day, etc.), but they kept paying the same rate as a regular day until a lot of us started bitching and finally they said they would pay us time and 1/2, and that only started on july 4th this year, my question is this; is this company breaking labor law?, why do they pay their employees double time on major holidays and we only get time 1/2 ?, in fact they rest their in-house techs those dates to save having to pay them but we (independents) have to work for less, isn"t there a law that prevents this?, why would the law only apply to employees?, I like to hit this corrupt company with a class action lawsuit if possible, they need to be hit hard for their actions, there must be a law that protects all working people from scumbags like these,

I went to the CA labor board for advice and they said that thay can only help employees and not "contractors" like me because I have the "right to refuse" the work, the problem is that we get suspended for up to a week if we refuse to work holidays, so in fact they use mafia tactics to punish the contractors that don't go along with their f**ked up policies, Im tired of being treated like a ni**er anymore and I hope to god that I can do something in the courts to fix these greedy f**kers.

Hi XXXXXX,

You are not alone in your complaint as your company has classified you as independent contractors. It simply is cheaper for companies to use the IC route.

Is it legal? How much they control you in the course of a work day will determine that. The Labor board could not help you because they DO really only deal with employees.

Your law, so to speak, is how the IRS defines an independent contractor. Each complaint is taken on a case by case basis. You have to prove that you are indeed an employee, and not an IC.

Recent major lawsuits dealing with this issue was Fedex Ground, and the big one was Microsoft Corporation. I see you are in CA, so you definitely contact Calbar.org www.calbar.org, the California State Bar and see if there are any attorneys who are willing to fight this fight for you. Many do. That is an excellent resource to use.

Do I think you are misclassified. Yes, from what you have presented. But you have a long hard fight to prove this. Good luck with this, the first step is to copntact an attorney through the California State Bar.
