Yes i was here in April 1999. and my driving licence prove that. my 1-485 was denial bass on the inproper fileing of the 1-130 By my Brother in April 26, 2001 my lawer the not tell me.the fee the lawer sent was wrong. it was rejected and he resent it. Notice Date sept 4, 2001 and pening My wife is fileing1-485 for me now. if MY case can be grafather. but it was denie. will the jugde aprove it likely. it was not my fault.

The fact that your attorney made mistakes will not change anything. However, If you are, or have ever been, in deportation (removal) proceedings, and the proceedings aren't yet over or are on appeal, your entire immigration situation is in the power of the courts.

 

Therefore, the judge has the power to effect the outcome of your case. Therefore, If you are already in removal proceedings, your application must be re-filed with the court and immigration judge presiding over your case, and you should seek a lawyer's help.
