Question

Hi, I have a daughter who is a dual citizen (USA/CANADA ). She was born in South Florida, and is now living in Winnipeg, Manitoba since she joined the "ROYAL WINNIPEG BALLET COMPANY" about 5 years now. Anyhow, she was recently married to a CanadXXX XXXXX man by the name of T.J.Gudilin. Her name is XX-XXX XXXXXX XXXXXXXXXXX. She recently began to use her husband name which is perfectly normal, but it is going to be Jo-Ann Debbie Gudilin. Let's say that some day they decide to move to the States, does she have to leave Sundermeier as part of her name, to help her husband get a Green Card ? I would deeply appreciate an answer regarding this issue.

Hello,

She can choose whether or not to retain her maiden name; this will not have an effect on whether or not her husband can get a green card. On the petition, there is a field for "all other names used," so in that field, she can indicate that she has gone by both names.

Therefore, would it be better for her to go by Jo-Ann Debbie Sundermeier Gudilin , or Jo-Ann, Surname, Sundermeier, as middle name, and Gudilin, as in Last name, or Jo-Ann as Surname, Debbie, as in middle name, and Gudilin as her last name to help her husband get a green card, since he is Canadian. If they ever decide to move to the States. As of now, they do not plan to move to the States, but maybe someday. I am just trying to find the best way to call herself without any problems and attorney fees in the future. You never know what the future might bring you. Hi Maryse,

It doesn't make a difference -- she can choose whatever legal name she prefers, and she should indicate that as her name on the petition. In "Other names used," she can indicate that she has gone by other names as well (if applicable).

It won't help or hurt her husband's case whether or not she takes his last name; it will only matter that their marriage is genuine (as evidenced by marriage certificate, photographs, etc.), and that he does not have any criminal history that would bar him from getting a green card.

Hi again,

 

Let me make myself clear and to the point. If my daughter Jo-Ann, who was born Jo-Ann Debbie Sundermeier in South Florida in 1983, changes her name to Jo-Ann Debbie Gudilin, and does not use S., or Sundermeier. Will she loose her USA citizenship ? That is what I want to know.

 

Example: Jo-Ann Debbie Gudilin resides in Winnipeg Manitoba, Canada for 20 years or so, and she decides to move to the States. Will she loose her USA citizenship???? Sincerely,
