I am being sued for $700 dollars for breaking my lease and damaging my apt. The damages I am being sued for were already reported and I took pics of when I moved in. I moved bc of a fire above my apt on Labor Day. No one knew of the fire bc management silenced the alarms. I went months w/out utilities even after reports to management and codes. I had graffitti on my walls the day I moved in that I also took pics of. MY major concern in how can I countersue for my utility rebates? My lease states if I can prove negligence I am entitled to a full daily rebate and if after 48 hrs the right to term the lease. I believe them having the alarm on silent and holding the alarm panel together with tweezers and tape is negligent. ( I have a fire incident rpt that has that statement in it) I just want to know what are my options bc they are trying to sue me for bs.

you should defend and countersue claiming that the damages were pre existing, that you have proof by pictures and testimony, and that you are entitled to your security deposit back.
