Question

My last day of employment at Ansaldobreda, Inc. was June 11, 2007. We negotiated a 12 week severance that ended on Aug 31, 2007. After waiting in vain for over 2 months to receive my COBRA application, I contacted the Department of Labor to solicit the Employer. Since my requests were being ignored by the Head of the HR Dept., in March 2008 I contacted the Vice President who had ended my position. I informed him of the urgency of the matter and that I had interrupted my HIV treatment for over 6 months due to the lack of medical coverage.

To this day a year and $6,000+ in premium payments later I still do not have the same medical coverage I used to have as an employee and which I am entitled to. Although I had relocated back to NYC right after my work relationship ended in San Francisco, Ansaldobreda enrolled me in a cheaper plan that only covers me if the claims are issued in Aetna's network limited to the State of California. How can solve this issue?

I need the following answered before I can answer your question. Sorry – it’s a little bit of a different process from sitting in an attorney’s office.

Can you please tell me whether or not you contacted the agency that monitors insurance in Calif? Anyone else besides DOL? What does DOL have to say about the company not giving you the correct policy?   

As I'm sure you know, you were entitled to COBRA for 18 months after leaving the company. You were to receive the same coverage you had previously, but would have had to pay for it yourself. After that, you could flip to an indivicual policy.

Thank you for addressing my question. For some reason your response got lost in my junk mail folder and I was only now able to retrieve it.

To answer your question I did not contact the agency that monitors the insurance in California simply because I wouldn't know who to call. . .I did not contact the Department of Labor about having been enrolled in a different policy than the one I used to have. I contacted the DOL back in November 2007 two months since my last day of employment and I still had not received the COBRA application package from my employer.

One of the reasons why I have not contacted the DOL is because I'm afraid that if I do, they will call my Company, then the Company will switch me to the right plan and that will be it. If there's a way to at least have them cover the $7000 I paid so far in premium payments for nothing, not to mention the great disservice they've caused me especially considering that in March 2008 I informed them of the urgency of the matter, that I am HIV +, and that I had interrupted my treatment because of the loss of my insurance coverage, and that I could not wait to receive proper medical care any longer.

I am not sure how much of this is going to help, but I had been working for Ansandobreda for 7 yrs at the company headquarters here in NYC. Then in November 2006 they announced they were shutting down the NYC office and relocate the headquarters to San Francisco. Since nobody wanted to follow and I had been with the Company the longest, the CEO offered me a $20,000 raise, a promotion, and commitment (all verbally of course!) to apply for my green card to relocate with them. In February 2007 I relocated to San Francisco to start up the new office by myself. . . In April 2007 they switched plans with Aetna the insurance company. The coverage was the same, but I believe we were passed on to the division that covers California accounts.

Then, when on June 8 I received a termination letter via email, I decided to move back to New York, in fact at the same address I used to live before relocating to SF. When I applied for COBRA I had given my NYC address, but the insurance broker they are using simply enrolled me in the same plan the Company currently has, which is not necessarily what I used to have for the last 7 yrs.
