Question

Is it illegal to spead fliers telling of a woman's drunk driving arrest, trial, and subsequent guilty plea of "negligent operation of a vehicle"? If convicted of drunk driving it would have been her third and jail time. The woman who wants to distribute the fliers is the person who was hit by the drunk driver and she feels people should know this other woman is still free to roam around while drinking and driving.

1) It is not against the law to provide true statements of fact. You would only face civil liability if you convey false statements. So all information you convey, must be true information that can be verified by documentation.

2) You cannot post fliers on private property without the consent of the owner or obtaining a permit to distribute fliers upon private property. You can post on your own private property, but not on the private property of others or on public forums or sidewalks without getting a permit or license to do so according to your local city ordinance. If you intend to post in your own vehicle, you may also need a permit to do this, so contact your local city hall for specifics to this.


But to answer your question, it is not illegal under the first amendment to disclose public information that is true.
