JD 1992:Hi. I read your question and thought it might be quicker to chat rather than go back and forth
norefills:thank you
JD 1992:What did teh police tell you when you talked to them?
norefills:because i do not own the house (it is my grandmas) i can not file for an eviction
JD 1992:Ah. I see the problem with that. Do you have your grandmother's permission to live there?
norefills:yes, i do.
JD 1992:Then I disagree with them. All you have to have is a right of possession to evict him. The easiest thing to do is have your grandmother give you a power of attorney to handle all aspects of that piece of property. Then you can tell him to leave and when he doesn't file criminal trespass charges OR file an eviction.
JD 1992:The police are wrong but it's usually fruitless to try and argue with them
norefills:i agree with that. i dont really want to bring my grandma into it but if thats what it takes i guess i will have to...what about a restraining order? would he have to leave then?
JD 1992:He would, but it is a lot more expensive and time consuming to get one of those. The two best ways are eviction and trespass.
JD 1992:ANything else I can answer for you? I don't want you to have to pay for any more time if you don't have to
norefills:no, that helps a lot. thank you
