Question

We have a Yamaha Wave Runner GP800R. On the 4th of July the trottle stuck open on the Wave Runner running across the lake by it self going around 30 miles per hour. Luckly no one was killed or injured. The Wave Runner was run off the lake by a boater hitting the shore and damaging the Wave Runner. This machine is not under warranty but this should not be an issue since we feel this is a defect in the Wave Runner. The laynard came off of the pin which should of stopped Wave Runner but did not. We have contacted Yamaha about this and they said they were going to check it out. They called back 3 weeks later and said nothing was wrong with it and would not do anything about it because it was not in warranty. The Wave Runner we feel was never checked properly by Yamaha. We feel this is not a warrany problem and should be addressed before someone gets killed or injured. We would like to be compensated for the loss of the Wave Runner but Yamaha refuses to do anything about it.

Hello. What you are describing is a potential product liability action. In order to proceed with this, you would need to retain an attorney, which of course will cost you. However, to prevail you would need to be able to show that the damage was caused by a defect in design and/or manufacture, and not by your actions or a failure to maintain the vessel. This may be a difficult burden to meet. Did someone from Yamaha actually examine the Wave Runner, or did they rely on a third party report? What was the value of the total damages to the machine?

We were told to take Wave Runner where we bought so a Yahama specialist could look at it. When they called back and said they said they had inspected the thottle and nothing was wrong but we talked to the service people where Yamaha told us to take it and they informed us that no one has even looked at it.

I suggest you let Yamaha know that, and suggest to them that you will take legal action if the situation is not addressed to your satisfaction. They may not be willing to take a chance on it (or pay the expenses involved) and may settle with you.
