Question

My wife was employed as the Executive Admin for the CEO of a large international company. During her 3 weeks in this position she was told to receive, copy and forward numerous sexually explicit emails including a video that the CEO made her display in front of other execs, on her cmputer showing female nudity. In addition she was barraged with numerous hostile tirades by this man that included the "F_ _ _" word used extensively. He would frequently snap into fits of rage and intimidate her. She feaered going to work and feared ever making a mistake, or doing something he would blame on her for fear of his tirades and intimidating yelling - often in front of other highly placed executives. Does she have a hostile work environment case?

Accepted Answer

Your wife can file a complaint with the state commission on human/civil rights regarding the hostile environment created by the display of sexually explicit material. As far as cursing, according to the U.S. Supreme Court, the harassment/discrimination/hostile environment laws are not designed to be a code of civility in the workplace, so his cursing will not be a factor unless he was only doing it because of her sex. Once she files her complaint with the commssion on human/civil rights, then she can hire an attorney and sue the company based upon the outcome of the commission's investigation.
