I moved from tn to fl 4 years ago, left my husband took the kids. Due to yrs of mental/some phys abuse. We attempted at a long distance reconciliation-did''nt work. almost 2 years ago the teenboys went back to tn to him. Our 6 yr old girl remains with me. He paid some on line service to prepard dissalution docs in TN-just got the emailed docs today. I see many mistakes-Such as him requesting alimony/child supt/he keeps the house & possessions/ all rights/ I filed for cha 7 last yr which included a suv, that was picked up-repo. I don''t owe on it, he originally co-signed on it. They tacked it on to his cha 13- In this paperwork, he re-assigns the 10k suv debt to me which I previously filed under cha 7- Can that be done? I am retaining a fl atty tomorrow. Spouse said, go ahead & sign the docs so I can File-I did''nt tell him I''m trying to beat him to the punch so I can retain my FL atty to contest. He makes about 50k/yr I made approx 13k as self employed. He holds a BS degree/I have a hs diploma, he has 401k,stock options, etc. I have nothing except when he refinanced our tn home in nov''08in his name only, the title co said I did''nt have to sign the quit claim deed he was telling me to sign. Instead of signing the loan papers & sending them back, I drove 4 hrs to tampa and met with the title co who was handeling the refi. It was at that point that they informed me that I was giving him the ok to refi in his name only, but because I would''nt sign the quit claim deed, I retained joint ownership to the property.

I understand that you question your husband's actions regarding the debt of the truck--you are correct in that the debt should have been discharged in bankruptcy unless, because he signed the loan, they are coming after him personally for the truck. If they are coming after him personally for the truck then he may be able to include that in the joint debts. His other actions--asking for support when you make $13,000.00 per year and are supporting a 6 year old--does not make much sense. You are taking appropriate action by consulting with a FLA attorney. Reply to J D Haas's Post: You did'nt address the issue concerning the property/quit claim deed not signed/do I still have ownership even though he refinanced in his name only

I do not have access to the documents in this case such as the deed and the refinance contract. Generally, if a person's name is on the deed that person has rights to the property that are not extinguished by another person refinancing.
