Question

My husband and children are disabled. We moved into a townhome on 1 June 08 and on 18 July we received a letter to vacate or eviction proceedings would be initiated. We have paid the rent on time. The letter states that we did not adhere to the rules and regulations of the lease. Allegedly, my children mistreated their guinea pigs outside. The guinea pigs are fine. The management company did not give me the name of the person who allegedly witnessed this. THis was also not the reason given in the letter, only that we violated all the rules and regulations. We have never been given a written warning about anything, no police has ever been called or came to the house. We had 12 days to move and it has been very hard on my husband (100 % disabled) with severe dementia and my 3 children. Is there a chance to recoup some of the moving costs? Thanks, this happened in Burnsville, MN.

If Eviction proceedings haven't been inititated, you do not have to move. Let eviction proceedings take place. Once served, answer the complaint immediately asking for a court hearing and that the landlord provide proof of your violation of these rules and regulations. At the hearing, if the judge decides to evict, he can insist that you be given extra time to find a new home. I would not suggest moving with eviction papers actually being filed.
