Question

Recently my brother passed away with no will. He was indegent and living with my mother who suported him since he had no job. He left a daughter who is sixteen and living in Louisana with her mother. The mother is pressuring us for his personal belongings. The only thing he left of value was a truck, lap top computer and electric gutar. We gave the daughter the lap top and gutar but we wanted to sell the truck to cover the funeral expensise that my mother incured. Does the daughter and her mother get the truck? or does my mother get the truck to cover the funeral expense?

Reply to rvlaw's Post: Mr. Rich, they were never married and only lived together less then a year. My brother lived in Texas as do the rest of his family.

So the wife inherits nothing...the daughter inherits all, but the estate as she inherits it must be used to pay estate expenses such as funeral bills his mother is entitled to reimbursement.

Reply to rvlaw's Post: Can we as a faimily put her money in a trust of some sort until she is 18 years of age. We fear the mother of our nease will spend any money's on her other children from other fathers and not on our nease. does this mean she inherits all his old deits also or do we settle them?
