Question

I reside in Georgia. My 82 yr old mother and 36 yr old downs syndrome brother reside in Tennessee. Do i need a conservatorship for my handicap brother should something happen to my mom... her will is clear that i will be his guardian, but in the event she has a stroke or some other disability that would warrant a change for him in care.... do i need to get one here in Georgia or Tennessee?

You should get conservatorship for your brother and you will need to file where he resides, in Tennessee to do so. If your mother has conservatorship currently and is capable of doing so, she can sign a voluntary transfer of conservatorship, which you then need to file with the court in Tennessee and obtain an order agreeing to the voluntary transfer. If she does not already have conservatorship, then you need to file on your own in Tennessee.
