I had a doctor patient relationship with a doctor for a year. I did not sign any type of release form giving him permission to release info. about me to anyone. I also asked him at least 6 times if my son calls not to give him any info. about me. And the doctor released info. to my son anyway. Was this doctor in the wrong for giving info. to my son? The info the doctor gave out was about my health and my medications. Since then I have tried to contact a lawyer to help me on this matter. I am in the process of filling out the form to file a complaint with the Medical Board. Can you please let me know if I am right or wrong about my privacy with this doctor was violated. Can you also give me some leads to lawyers in Denver,Colorado. Thank you for your help.

I am sending you a link to the HIPPA guidelines (www.hhs.gov/ocr/hipaa), but wanted to point out a couple of things. First, I think you should report the doctor. You are given 180 days to report.

Second, there are no personal damages allowed by a HIPPA filing. You can consult with an attorney in Denver who specializes in health care law to see if you have a private suit against the doctor. www.denbar.org. Talk with several lawyers and see who you like best. Generally there is no or a minimal fee for the first consultation. You can file the HIPPA complaint on your own without a lawyer.
