Question

I hired a painting co. to paint 4 log condos. It wasn''t done in a timely fashion and with in 6 months there was not sign of it being painted. The logs were as dry as they were before they started.I had some other professionals look at it and they felt the had deluited the oil stain with paint thinner, which oxydizes the stain and in a short time all thats left is the color no oil. I hired a new company to repaint it and it looks great and the logs even bead up when it rains. I would like to get my money back of 9,000.00. from the 1st painter.

Depending upon the written contract with the first painter, you would need to file a suit against the first painter. The reason I say dependent upon the contract, is that many of these contracts now contain a dispute resolution clause that mandates arbitration. If the contract mandates arbitration, then you must file for arbitration and not a law suit. If it does not mandate arbitration, you would file a law suit against the company for breach of contract for the money back and make sure you get some written proof from the other professionals to use as your witnesses. You would do best having an attorney file the suit for you.

So, what was your question? All you stated was that you would like to get your money back from the first painter and I informed you that absent an arbitration clause you would have to file a law suit against the painter for breach of contract.

You know I already knew that. I wanted to know more of the law on suing, what judges do in these situations. I want to talk to some one who can do a walk thur with the experience having this problem and what happened to them, mistakes they made things that put the nail in the coffen. Your answer was way to general. Thats why I already knew that.

You have a claim for breach of contract. In order to file suit you would have to draft a complaint (or have one drafted by an attorney). In the complaint you would have to state sufficient facts to make out your claim for the breach of contract (the fact he said he would do the work, he did not do the work, and if he is claiming he did the work he did it in such a poor manner as that it did not satisfy the contract). Once the complaint is drafted, you must file it with the court and serve the complaint and summons on the painting company. At this point, the painting company has 20 days to answer the suit after which time you can file for a default judgment. There will be a discovery period during which you can seek discovery and take depositions from anyone and the other side can do the same. After discovery closes the case will proceed to trial. Your amount is over thwe $3000 limit to bring this suit in small claims court. You should also seek attorney's fees and costs as part of your claim.

Courts will read the contract on these cases to determine exactly what was supposed to be performed. The court will then hear your evidence regarding the lack of performance or the fact that the performance was so substandard that it was effectively no performance at all. This includes your witnesses, which you will have to qualify as experts before the court and this requires some special steps that are fairly complicated, which is why I suggested you hire an attorney. After you present you case, the defendant gets to put on his evidence of how he did the job properly. Judges are generally not going to side with a business that did not do work they contracted and were paid to perform.

Again, the most critical thing is lining up statements and reports from your experts.

I want an answer to my question and all you say is that we need more specific questions. I gave you my question, answer it. Don't throw it back at me.If I new the details I wouldn't ask the question. Your first answer was a joke. I want a legal answer to my question, not short cut, give me an answer that is more than I learned on the internet typing in breach of contract, again what I knew I was suing for and how to proceed, not just say hire a lawyer.
