Question

yes I had a sears credit card and have become disabled and cannot pay the bill which is a little over 8100.00. I have been sold out to a collection agency and they are going to either have a civil case or put a lien on my property. My husband and I are on a fixed income from SS each month. I had made arrangements with citibank for 137.00 a month for 60 months, but that is all gone now. I was wondering if they can garnish our social security, or take our home and vehicle away and make us home less. My husband only works part time when he can, he also works for himself. Please help me out. I want to pay them but I can't make the big payments they want. Thank you troubled

No the credit card was in my name only.

Answer

They cannot garnish social security and they cannot take property that belongs to you and your husband.. So you have a strong negotiating stance..

I can't not afford a lawyer I feel so bad about this it has upset me to the point my husband had to take me to the emergency room to be treated. What about our car will they put a lien on our house and property? so worried

Only on itmes titled to you alone can they execute.. I fthey file a lien, that just means if you sell it you pay... that is different than an execution, where they actually sell the property...
