Question

I have several loans with a cosigner, how can I get them off. Can he file a civil suit against me and I say I am the sole responsible party and take him off this way.. I can not get it refi my self or have anyone else that can cosign. THey are private student loans. What can I do to get him off legally.

Thank you for your question.

The only way in which to get a co-signer off the loan is to refinance the loan without the co-signer. If you are unable to do this, then he will have to stay on the loan. A court order can only make the adjudication about who is responsible for paying the loan; however, a court order cannot make a lender remove a legally valid co-signer from a loan.
