Question

I purchased a 2003 toyota 4 runner in October of 2007. It has the limited emblem on both side of the vehicle. When I asked the salesman what the limited edition was, he told me the tow package and power windows and locks, whick the vehicle has. I just recently took my car to trade it in and, after appraisal they infomed me that the vehicle was not a limited and they verified by entering the vin into a national database. The limited is supposed to have many additional options that my vehicle does not have. What is my recourse? The value difference is approximatelu $3,000.

Answer

If it shows on your original paperwork with the sticker that it is a limited edition you can sue the dealership for the difference in the value. You can file in small claims court in your home town which is set up to deal with people not using lawyers. This is fraud in my opinion.

Reply to XXXXXX XXXXX's Post: The original paperwork does not show any designation. Be it "Limited" or "Sr5". But the vehicle itself is labeled limited. Do I still have recourse?

Accepted Answer

It is not quite as good a case without it on the paperwork but you still have a claim you could pursue based on the labeling of the vehicle itself which you relied upon.
