Question

I am being sued by a check cashing place for a check on which I was the payee for NSF. The check was cashed four years ago and this is the first I have heard of it. I was never contacted when it bounced and now they are suing me for interest and penalties. Can they legally do that? Why aren''t they suing the person who wrote the check? I am in Virginia

Well,

I understand your situation, I had the same issue bout year ago. I appeard in court, and motion for dismissal , being that I was not the party who wrote the check, and I alsl for a motion for joinder, this will add th person who wrote the check.

I beleive there is already a motion for joinder but I am wondering what legal grounds there are for dismissal

Grounds,

You accepted the check of th grounds that th check was/would be honored and funded. This is my defense,

and that the party issueing the check knew and had knowledge that the check was bad, and was mad to defraud you.

unfortunately I don't think that will fly in court. You may have more acces to legal websites than I do. Do you happen to know what the statue of limitations is? This will be my last question I promise then I will accept

It is what happened. The judge wants a letter of defense submitted and I have been having a hard time looking up the laws for Virginia thank you for your help I will use that and see how it goes. Thanks again
