Question

I live in Augusta GA. My neighbor has some trees that are tall and have branches that extend over the roof of my house. I''ve lived here for three years and have not minded the trees, but a couple of weeks ago one of the smaller lower branches fell and landed in my patio. It took me two days with a chainsaw to get the branch out of my patio and I noticed how close the other branches were and how much damage they would do if they fell. Is my neighbor required to trim his branches that reach my roof? If he does not and they cause damage, is he responsible?

I contacted the property manager for the house that has the tree (its a rental property). He said he would take a look at it and let the property owner know.

What you need to do is send the following letter to your neighbor via certified mail with a return receipt requested

Dear

This is to inform you that you tree is so overgrown it is hanging on my roof and I am concerned that it may cause damage. Just last week, one of the branches fell onto my patio and I had to work hard to clean it up. Thankfully, there was no damage at that time. You are required to keep the tree in good enough condition that there is no threat of danger or damage. If you fail to do this and the tree does cause damage, you will be fully responsible for any and all costs associated therein.

Thank you for your prompt attention to this matter,

SIGN It. Keep a copy and mail as I stated above. If the tree is not cared for and some damage occurs then the owner will be responsible, but they need to have the notice that there is potential damage. That is why you must send the letter.
