Question

my girl friend is 17 and one month pregnant, I am 27. Can her parents have me charged with any type of sexual abuse charge in Alaska. We want to get married, but the legal age without parental consent in Alaska is 18.

Looking answer up in Alaska State statue and not sure if I am interpreting it correctly, but her Mother keeps threatening that she will take her down to the police department and file a sexual abuse charge against me. I'm thinking she can not do that to me. Otherwise my girlfriend will go get an abortion in secert so I can not be charge with anything. We planned to get married when she turned 18 and I am more stable finically. I do not want our child aborted, but we may not have another choice if I can be charged with a crime.

Reply to LawNinvest's Post: I am just her boyfriend and have no position of authority over her. I work construction and in the local fish processing plan here when there is work.

Accepted Answer

Thank you for your patiences while I was reviewing the sex offenses for Alaska. Based on the information you posted, her parents could not charge you with statutory rape. First, the age of consent in Alaska is 16. Second, you would only be in trouble if you had sex with a minor 17 and younger if you held a position of authority. Since you state you do not have that capacity, then you cannot be criminally prosecuted.
