Yes, you can record a traffic stop as the roads are a public forum and there is no reasonable expectation of privacy expected. The wire tapping laws have to do with recording private communications without the consent of at least one party or you being a party to the communication. A traffic stop is not a "private" communication because it is conducted on a public location (public forum).

No, they have no right to take your recording device unless such device is evidence of a crime. The actual recording of the traffic stop is not a crime. So no.
