Question

How do i legally get my husband to leave our home so my daughter and i have a place to live. he signed of on the house and it is in my name only. He says he will not leave. we are currently living with my parents for the last week. Can I have the power turned off?

Hi,

Since CA is a community property state, title does not mean that the house is yours and not his. I'm afraid you will have to do one of two things:

1. Enter divorce mediation and hopefully enter an agreement that he leave at least in the short term.

2. Commence a divorce action and ask for temporary relief in the form of an order compelling him to leave...but that will be difficult because legally he has a right to be there, and no you can't turn off the power. Sorry.
