Question

My grandmother''s last will has been misplaced or destroyed. How can I get a copy? Is it public record now that she is deceased? We have a will from 1981 but it is not the most recent and there is no info on it as to whom drew it up. Thank you. Kristen

If your grandmother's will was submitted for probate, the court where it was probated will have a file with a copy, and yes, it is a public record if it was probated. If it was not probated, it will not be on file with the court and it will not be a public record.

No. Trusts are designed so that property can pass without probate. However the trust itself might be filed with the court depending on what state you are in.
