Question

Please help. I have a motorcycle financed through honda finance company that I am over 3 months late on. I recieved a phone call on friday nite at 1030pm from a repo man, claiming to be an officer of the law, stating that i give him the bike within 24 hours or he would issue a class c felony here in tennessee for hindering a lender in default. I explained to him that I was currently out of state and would not return till monday and he said ok. Well tonight he called me at 700pm and explained that he was a repo man and he would not wait on me till monday my time was up and he was filling for a warrant. I told him that I am not trying to hide this vehicle it is locked up where he cant get it till im there but once home tomorow i would gladly give him the bike. I also asked him if he would let me speak with the finance company before hand and he said no he is filling the warrant. Can he do that? I thought only th finance co. could? What do I do? I have the money to pay what i owe.

Answer

Get ahold of the finance company in the AM, and try and straighten it out... if you can get them paid down, they will back off!

He could apply for a repo warrant on behalf of the finance company.....

Reply to Legal Professional's Post: a search warrant yes is that a repo warrant? i just don't want a felony warrant, is it a felony warrant or search warrant? i will take them to the bike gladly

Accepted Answer

If he's a cop it could be a felony warrant, but if he's a repor man, then he can't swear out criminal charges without the police... And repo guys will lie...
