Question

I paid a company to clean carpets at a rental I own. I live in CA. but had this done over the phone to Austin, TX. Now I have been sent a bill from the carpet cleaning co. who actually did the work. They never got paid by the company I contacted for the job and paid. I can not get ahold of the guy I paid for the job. Am I responsible to pay again for the work from the people who actually did it ?

The short answer is no. They were hired by the person you hired. You fulfilled your obligation.

They have sent a letter stating that if they are not paid they will pursue legal action. Do I ignore the letter or respond?

Respond and explain.... offer to help if they need you with the other guy, but then defend if they sue (although it might be cheaper to pay than defend, so you may settle anyway..)

Does it matter that it happened in Texas? Is the law on this the same for me in Texas as it is for me in CA. or for the state you practice in?

The law is different everywhere, BUT the precepts are the same.

After all you are paying $9.00 not for an hour of research....

That said, basic contract law. Same as if I hire lawn mowing service. He subcontracts to guy with mower. The guy with the mower doesn't get paid, not my problem.
