I have worked just under 3 months at a new position. Since I''ve been there, I have increasingly become uncomfortable that my boss is hitting on me. About a month ago, it became more intense. I was there late with her and she was leaning into me and touching my leg and bringing me gifts and complimenting my hair. I became very uncomfortable and left rather abruptly. She is in the top position at the company and I am right underneath her. After this incident, she seemed to be busy and did not answer my emails. Now she fired me today.

You have described the components of a sexual harassment lawsuit. Now you have to decide whether you want to bring one. But this kind of "subtle" sexual harassment might be hard to prove. Touching your leg, bringing you gifts and complimenting you might be explained away as simply being friendly. It is not the same as something more "overt" like trying to take off your clothes, kissing you, her taking off her clothes, etc. I am not saying that you can't make out a sexual harassment suit, especially if she was acting very suggestively towards you over a period of time, and especially if she actually said anything about being interested in you. Remember, too, that a sexual harassment suit is a very tense and uncomfortable experience, and even these days, a lot of people are still skeptical that a man can be sexually harassed by a woman.
